Frequently Asked Questions
- Q: What is the mutual consent divorce process in UP?
A: Under Section 13B of the Hindu Marriage Act, spouses who have lived separately for at least one year file a joint petition (first motion) before the family court, followed by a second motion after the cooling-off period, after which the court grants the decree. Terms on alimony, custody and property are usually settled first.
- Q: Can the six-month waiting period be waived?
A: Yes, in suitable cases the court may waive it, for example where the parties have settled all issues and have been living apart for a long time.
- Q: How is maintenance or alimony decided?
A: Courts look at the income, assets and needs of both spouses and any children. Maintenance can be claimed under the Hindu Marriage Act, Section 144 BNSS (earlier Section 125 CrPC) and the Domestic Violence Act.
- Q: Do you advise on 498A cases?
A: Yes. Section 498A IPC now corresponds to Sections 85 and 86 of the Bharatiya Nyaya Sanhita. We advise both complainants and those accused on the law, bail and settlement options.
