Buying land, a plot or a house in Varanasi is often the biggest purchase a family makes. Most property disputes we see could have been avoided with a few checks before the sale deed was signed. This guide explains what a proper property due diligence in Uttar Pradesh covers, in the order we usually do it.
In short (Hinglish): Property kharidne se pehle kagaz (title, khatauni, bhar mukt praman patra, naksha) aur zameen ka muayana dono zaroori hain. Sirf seller ki baat ya broker ke photocopy par bharosa na karein.
1. Check the chain of title
Ask the seller for the full chain of ownership documents, not just the latest sale deed. Each earlier sale deed, gift deed, partition deed, will or succession document should link one owner to the next without gaps. A common practice is to trace the chain back 12 to 30 years. Look for:
- Whether the seller is the sole owner or one of several co-owners or legal heirs
- Whether all co-owners or heirs will sign the sale deed
- Powers of attorney in the chain, and whether they were valid when used
- Any minor's share, which needs special care
2. Match the revenue records (khatauni and khasra)
For land in Uttar Pradesh, the khatauni (record of rights) and khasra details can be checked on the UP Bhulekh portal and at the tehsil. The name in the revenue record should match the seller, and the gata (plot) number and area should match the documents. If the land was recently bought, check that mutation (dakhil kharij) has been done in the seller's name.
3. Get an encumbrance certificate (bhar mukt praman patra)
An encumbrance certificate shows registered transactions on the property, such as earlier sales or mortgages, for the period searched. In UP it can be applied for through the IGRS UP portal or at the sub-registrar office. Remember that it only shows registered documents. It will not show unregistered agreements, family disputes or pending court cases, so it is one check among several, not a clean chit on its own.
4. Check land use and approvals
- Agricultural land: if you plan to build a house or shop, check whether the land has been declared for non-agricultural use under the UP Revenue Code, 2006.
- Building plans: for houses and flats in the city, ask for the map approved by the Varanasi Development Authority (VDA) and compare it with what is actually built.
- New projects: for a flat or plot in a project, check its registration on the UP RERA website.
5. Look for disputes and dues
- Search the district court and other court records for cases involving the property or the seller.
- Ask for recent house tax and water tax receipts from the Nagar Nigam and the latest electricity bill.
- Check whether any bank loan is still outstanding on the property and, if so, how it will be closed before or at registration.
- For larger purchases, consider a public notice in a newspaper inviting objections.
6. Do a muayana (physical site inspection)
Papers alone are not enough. A muayana means visiting the property to confirm that:
- The boundaries and measurements on the ground match the documents
- The seller is actually in possession, and there are no tenants or occupants claiming rights
- There is legal access to the property (a road or a recorded right of way)
- Neighbours do not report any dispute over the boundary or ownership
7. Draft and register the documents correctly
The agreement to sell and the sale deed should record the correct description of the property, the payment schedule, who bears stamp duty and registration charges, and what happens if a defect in title appears later. The sale deed must be properly stamped and registered at the sub-registrar office. After registration, apply for mutation in your name.
